HIPAA for Remote Employee

Joint Commission and CMS Workplace Violence Standards

Workplace Violence has escalated over the past 15 years, especially in healthcare. The pandemic has placed significant stress on the entire healthcare system. Unfortunately, in some situations, patients, visitors, and family members have attacked healthcare staff and put at risk the workforce’s ability to provide care.

Hospitals and health systems have long had robust protocols to detect and deter violence against their team members. Since the onset of the pandemic, however, violence against hospital employees has markedly increased. 

AI, Health Care & HIPAA - New Compliance Challenges

A decade ago, the U.S. healthcare industry had clear guidelines, standards, and implementation specifications under HIPAA for safeguarding the privacy and security of protected health information (PHI). Rapid AI Adoption: The U.S. healthcare sector swiftly enclaves AI technology to enhance healthcare delivery. AI systems process information, including PHI, which raises significant concerns regarding preserving PHI privacy and security compliance. Covered Entities and Business Associates in healthcare must navigate the complex task of incorporating AI while ensuring compliance with HIPAA regulations. This webinar provides an in-depth examination of AI in healthcare, explores the boundaries of HIPAA compliance, and addresses critical questions that demand immediate attention.

Discharge Planning: Compliance with CMS Hospital & CAH CoPs

This program will address the recent changes to the discharge planning standards, which were published in February 2023. It's important to note that CMS has not yet released updated interpretive guidelines and survey procedures that align with the new regulations. These regulatory changes are applicable to all hospitals, including Critical Access Hospitals (CAHs).

The program will delve into the Impact Act and its implications for hospital discharge planning. The Impact Act mandates standardized assessment, quality data, and resource data requirements. Hospitals are now obligated to assist patients with post-discharge care, including arrangements for home health services, skilled nursing facilities, long-term care hospitals, and inpatient rehabilitation facilities. Patients have the freedom to choose their post-discharge care options, and they should receive comprehensive information about these choices, with the exception of CAHs.

Grievances and Complaints: Ensuring Hospitals Compliance with the CMS CoPs, Joint Commission, DNV Standards, and OCR

Healthcare institutions play a vital role in society, entrusted with the well-being of patients. Ensuring hospitals adhere to regulations and standards is crucial to maintaining the highest patient care and safety level. The webinar delves into the importance of addressing grievances and complaints to guarantee hospital compliance with the Centers for Medicare and Medicaid Services (CMS), Conditions of Participation (CoPs), Joint Commission Requirements, Det Norske Veritas (DNV) standards, and the Office for Civil Rights (OCR).

A ‘Patient Grievance’ is a formal or informal written or verbal complaint that is made to the hospital by a patient or the patient’s representatives regarding the patient’s care, issues related to the hospital’s compliance with the CMS Hospital Conditions of Participation, or a Medicare beneficiary billing complaint about rights and limitations, all these complaints should be resolved by the hospital for prompt resolution of patient grievances. They must inform each patient whom to contact to file a grievance. There is no similar section for Critical Access Hospitals, and the requirements for acute hospitals do not apply to CAHs. Those facilities should have policies and procedures to address patient rights, including any grievance or complaint.

In her role, Ms. Dixon provided patient safety and risk management consulting and training to facilities, practitioners, and staff in multiple states. Such services included the creation of presentations on risk management topics, assessment of healthcare facilities; and development of programs and compilation of reference materials that complement physician-oriented products.

Paul R. Hales received his Juris Doctor degree from Columbia University Law School and is licensed to practice law before the Supreme Court of the United States. He is an expert on HIPAA Privacy, Security, Breach notification, and Enforcement Rules with a national HIPAA consulting practice based in St. Louis. Paul is the author of all content in The HIPAA E-Tool, an Internet-based, Software as a Service product for healthcare providers and business associates.
